Bloomberg Law ran a story this week with a headline that should make every hiring manager pause: “AI Hiring Tools Elevate Bias Danger for Autistic Job Applicants.”
It’s not often we see national outlets call the danger out so plainly. The piece names what many of us already know: algorithmic hiring systems punish autistic people at scale — not by inventing new prejudice but by automating the old kind.
Eye contact and vocal tone get scored in video interviews. Personality tests measure “positivity” and “emotional awareness” as if they were job requirements. Résumé screeners downgrade applicants who list autism-related awards or memberships. The result: autistic applicants disappear from the pile before a human even reads their name.
Let’s be blunt: that’s industrialized discrimination (my words, not Bloomberg's).
The Law and the Loophole
The article grounds itself in ADA law: tests must be “job related” and “consistent with business necessity.” On paper, that should protect us. In practice the Trump administration removed federal EEOC guidance on how AI can violate the ADA and Title VII. The law itself didn’t change, but enforcement clarity weakened. Companies are left to test-drive their own platforms — or not.
As the piece notes, that gives employers who want to do the right thing no roadmap — and those who don’t, a free pass.
Supportive Ally Work
From an AAB perspective, this report is what we’d call Supportive Ally journalism. The reporters aren’t autistic but they are doing protective work: naming the structural harm, connecting it to law, and exposing deregulation as an enabling structure.
That matters. Allies have reach that autistic whistleblowers often don’t. Seeing a publication like Bloomberg Law state flatly that autistic job seekers are being algorithmically excluded gives us evidence, not just anecdote. It’s a lever for legal fights already underway.
What’s Missing
But here’s the gap. The voices in the story are lawyers, policy experts and advocacy organizations. Autistic applicants appear only as categories: “a biracial autistic job applicant,” “others required to take Aon assessments.” We don’t hear what it felt like when the AI interviewer docked them for lack of eye contact or when their résumé got flagged for autism advocacy.
Without that narration, the story stays in compliance logic: test the tool, compare it to the ADA, make sure it’s “job related.” Those are necessary steps. But they don’t shift the frame. The question of why “positivity” and “emotional awareness” are considered prerequisites for accounting or data entry or software engineering never even gets asked.
